Acceptance of Terms
These Terms of Use govern access to and use of the MineTrack national mining compliance platform. By registering an account, signing in to any portal, or otherwise using MineTrack, you agree to be bound by these Terms.
If you are accessing MineTrack on behalf of a government ministry, mining company or other organisation, you represent that you have the authority to bind that organisation to these Terms.
Definitions
“MineTrack” refers to the national digital infrastructure platform for mining compliance, workforce, payroll and revenue assurance. “Government” refers to the responsible ministry and its authorised agencies. “Operator” refers to a registered mining company. “Worker” refers to an individual registered on the platform. “Portal” refers to any role-based access point of the platform.
Eligibility
Access to MineTrack portals is restricted to authorised users. Government, mine operator, inspector and bank portals require credentials issued or approved by the responsible authority. Worker portal access requires a verified national identity and an active or pending employment relationship with a registered mine.
You must be at least the minimum legal working age in your jurisdiction to register as a worker.
Licence to Use
MineTrack grants authorised users a limited, non-exclusive, non-transferable licence to access and use the platform for its intended regulatory and operational purposes. This licence is revoked if these Terms are breached or if your access is suspended or terminated.
Acceptable Use
You agree not to:
- —Submit false, misleading or fraudulent data, including ghost workers or duplicate identities.
- —Attempt to access records, portals or functions beyond your authorised role.
- —Share your credentials or allow another person to use your account.
- —Edit attendance, payroll or production records after they have been submitted or approved, except through approved override procedures.
- —Attempt to disable, reverse engineer or compromise the security of the platform.
- —Use MineTrack to retaliate against a whistleblower, worker or inspector.
User Obligations
All users must provide accurate and complete information and keep their account details current. Government users must act in the public interest and within their mandate. Mining operators must ensure their workforce, payroll and production declarations are truthful and submitted on time.
Worker & Employer Obligations
Workers must complete their own onboarding, upload genuine identity and bank documents, and report any unauthorised use of their identity. Employers must verify worker identity through the platform, ensure bank account changes are legitimate, and never add a worker to payroll without completed verification and valid attendance.
Bank account changes within 60 days of a payroll submission trigger an automatic hold. Attendance records cannot be edited after payroll submission. All senior approvals are permanently auditable.
Fees, Royalties & Tax
Mining operators are responsible for the timely payment of royalties and taxes declared through MineTrack. The platform calculates, tracks and reports royalty and tax obligations based on declared production. Late, partial or unpaid obligations are reported to the responsible authority and may result in licence suspension.
Intellectual Property
MineTrack, its design, software and published reports are owned by the responsible government authority or its appointed operator. Data submitted by users remains the property of the submitting party or, where personal, the individual concerned, subject to the government's regulatory right to use and retain such data.
Limitation of Liability
MineTrack is provided as a regulatory infrastructure. To the extent permitted by law, neither the government nor its appointed operator is liable for indirect, incidental or consequential damages arising from use of the platform. The platform does not replace the legal obligations of mining operators to pay workers correctly, pay royalties and taxes, and maintain safe operations.
Indemnity
You agree to indemnify and hold harmless the government and its appointed operator from any claim, loss or liability arising from your breach of these Terms, your submission of false data, or your misuse of the platform.
Suspension & Termination
Access may be suspended or terminated for breach of these Terms, fraudulent activity, or where required by an investigation or regulatory action. Mining licences may be suspended independently of these Terms under national mining law. On termination, your right to use MineTrack ceases immediately.
Governing Law
These Terms are governed by the laws of the jurisdiction in which MineTrack is operated. Any dispute arising in connection with these Terms is subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
Changes to These Terms
These Terms may be updated to reflect legal, regulatory or platform changes. Material changes will be communicated through the platform. Continued use of MineTrack after changes take effect constitutes acceptance of the revised Terms.
